Terms & Conditions

This Agreement is made between Calligraphy By Phuong (“CBP”, “we”, “us”) and the Client (“you”).

By paying your invoices, you agree to the following terms:

1. Booking & Payment

  • First invoice: A non-refundable deposit equivalent to the full design fee is required to confirm your order.

  • Second invoice: Payment equivalent to the full production cost is due once the final digital proof has been approved.

  • Last invoice: Exact shipping costs will be calculated and shared with you prior to delivery.

  • All invoices are due within 7 calendar days of issue unless otherwise agreed in writing.

  • All prices are quoted in USD unless otherwise stated.

2. Scope of Work

  • CBP will provide bespoke calligraphy and stationery services as agreed in the project quotation.

  • Any changes to the original brief requested by the Client must be agreed upon in writing and may result in additional charges and revised timelines.

  • Delays in feedback or approval from the Client may result in adjusted delivery timelines.

3. Design Approval

  • Digital proofs will be provided for approval prior to production.

  • The Client is responsible for thoroughly checking all details, including spelling, grammar, names, dates, and design layout.

  • Once approved, CBP cannot accept liability for any errors.

4. What Constitutes a Defect

  • Handwritten items & handmade paper: Natural variations in paper texture, ink flow, colour, brushstroke, or alignment are not considered defects.

  • Legitimate defects are limited to clear damage, incorrect wording not approved by the Client, or production errors that deviate from the signed-off design.

  • In the case of a legitimate defect, CBP will, at its discretion, repair, replace, or refund the affected item.

5. Complaints & Timeframes

  • Complaints must be submitted in writing within 7 calendar days of delivery or collection.

  • After this period, the order will be deemed accepted.

6. Delivery, Mailing Services & Liability

  • Shipping and Delivery

    • We provide international delivery through DHL Express and domestic delivery within Vietnam through Viettel Post (nationwide) or Grab Express (HCMC).

    • Shipping fees are borne by the customer and will appear on the final invoice.

  • International Orders

    • Orders shipped outside Vietnam may be subject to customs duties, import taxes, or other local fees upon arrival in the destination country.

    • These charges are imposed by local customs authorities and are the sole responsibility of the recipient.

    • We do not have control over such costs and cannot estimate their value in advance.

  • Mailing Services and Liability

    • Please note that we do not offer mailing or postage services. Once goods have been delivered to the Client, CBP is not responsible for any issues arising from the Client’s chosen courier or postal service.

7. Cancellations, Rescheduling & Postponement

  • If the Client cancels, the deposit is non-refundable.

  • If cancellation occurs after production has begun, the Client remains liable for all costs incurred.

  • Postponements or rescheduling must be agreed upon in writing. Price variations may apply due to new material or labour costs.

8. Variations & Price Changes

  • Quotes are valid for 30 days from the date of issue.

  • Significant changes to the project scope, timing, or quantity may result in revised pricing & timeline.

9. Intellectual Property & Licensing

  • Clients are welcome to share photographs of their stationery for personal, non-commercial use, provided CBP is credited where appropriate.

  • All designs remain the intellectual property of CBP.

  • The Client is granted a non-commercial license to use the stationery solely for the intended personal or private event.

  • Designs may not be reproduced, copied, or used for commercial purposes without written consent.

10. Use of Images for Marketing

  • CBP reserves the right to photograph and use images of completed work for marketing, portfolio, and social media purposes.

  • Client names and sensitive event details will not be disclosed without permission.

11. Data Protection

  • Data provided by the Client (names, addresses, event details) will be used solely for fulfilling the order.

  • Your personal data (including delivery information) will be handled securely and will not be shared with third parties except as necessary to complete your order.

12. Liability

  • Our total liability to the Client shall not exceed the value of the contract.

  • We are not liable for indirect or consequential losses, including emotional distress or event cancellation costs.

13. Force Majeure

  • Neither party is liable for failure or delay due to circumstances beyond reasonable control (including pandemics, epidemics, government restrictions, natural disasters, strikes, or supply chain issues).

  • In such cases, both parties will work in good faith to reschedule or fairly resolve outstanding obligations.
